Annual Leave

The Working Time Regulations apply to PAYE Temporary Workers only. Limited Company Contractors are responsible for complying with these regulations under their own Limited Company.
The Working Time Regulations constitute health and safety regulations relating to work and rest that all workers need to be aware of. The main provisions are:

  • Paid annual leave.
  • A limit on the average weekly working time to 48 hours.
  • Minimum daily and weekly rest periods.
  • Rest breaks at work.

Paid annual leave

  • From 1st April 2009 all workers are entitled to 28 days paid annual leave per year inclusive of public holidays.
  • Holiday pay is operated on an accural basis. Your holiday pay is calculated at 12.07% of your standard hourly or daily rate and will be paid to you when you take holiday(s).
  • The holiday year runs from 1st January to 31st December. All accrued holidays should be taken within the holiday year - unused holidays cannot be carried over and no cash equivalent payment can be made.

A limit on the average weekly working time to 48 hours

What this means for you is that you do not have to work more than 48 hours per week (averaged over a 17 week period) unless you choose to do so. The 48 hours does not include rest breaks, lunch hours or travelling time.
If you want to be able to work more than 48 hours per week, you can choose to opt out of this provision by signing an agreement, which we call an opt-out agreement. This form will beenclosed with your contract pack. Please return this form together with your signed terms of engagement and P45/P46.

Minimum daily and weekly rest periods

The regulations require that you have at least 11 consecutive hours rest between shifts every 24 hours and at least one whole day off per week (or two per fortnight). You cannot contract/opt-out of this requirement. If you have any concerns, please contact your Consultant so that they can help you work out an assignment schedule that will allow you to maximise your income while working within this regulation.

Rest breaks at work

You are entitled to a minimum 20 minute break when you work for more than six hours each day.
